Hi, and thanks for the quick reply, the account is new so that was not an issue but strangely enough it now seems to be working.

All good, finally the porting went through, just like to add this was a Telstra issue and it took me nearly a week to get the correct information.

Finally I've found out whats causing the issue, apparently when I first bought the pre-paid phone I used my Business name and although I'm the registed owner and person using the phone if it's put in a business name the account does not use the date of birth! With out giving away personal details I'll bring up the issue that seems to be causing the problem. Apparently the date of birth I've put on my application is coming up as incorrect during the port! Thanks, a bit more information came through via email about an hour ago!
Everything is now running and I have 20+ MB speed for the first time ever!
I was on ADSL and at the edge of it's range so never got more than 1.5Mbs
